§01The distinction, stated once

Primary evidence is the source itself — the artefact whose existence is the fact being cited. A Google Business Profile is primary evidence of a Google Business Profile. A state contractor licensing record is primary evidence of a state contractor licensing record. A published customer review is primary evidence of a published customer review.

Secondary evidence is a report about a primary source. An article that describes what a permit says is secondary evidence of the permit. A summary of a review is secondary evidence of the review. A re-mention of a licensing record on a project property is secondary evidence of the licensing record.

The distinction is not a ranking. Both are useful, for different jobs. What the file avoids is treating a report about a source as though it were the source itself, and vice versa.

§02What primary evidence establishes

A primary source establishes that the artefact exists, that it has the contents it has, and that its custodian is who its custodian is. It does not, by being primary, establish that its contents are correct.

§03What secondary evidence establishes

A secondary source establishes that a report about a primary source exists. Its value is in how it describes the primary source — whether it is careful, whether it adds context that would not be legible from the primary alone, whether the reporter did their own work.

Secondary evidence is filed with a note pointing to the primary. The file does not treat a secondary source as a replacement for the primary; where the two conflict, the primary is filed and the secondary’s divergence is filed too, with a date.

An example. A directory listing that summarises a contractor’s state licensing status is a secondary source for the licensing status. The primary is the state licensing record. The secondary is useful for how the directory frames the licensing status; it is not a substitute for the state record.

§05The trap the distinction avoids

The trap is to treat a widely-cited secondary source as if it were the primary. A secondary source cannot rise above the grade of the primary it reports on; a primary can. A regulator’s primary record earns an A on the four-grade scale for the facts it is obliged to state accurately; a secondary description of that record earns at most a B, because it is one step removed from the artefact.

Two consequences follow. Secondary sources are useful for framing and for discovery, and are filed for that; and no secondary source raises the confidence attached to a fact above what the primary supports on its own.
